HMCS CONFIRMS ARRIVAL OF 10 THIRD COUNTRY NATIONALS FROM USA

MBABANE – His Majesty’s Correctional Services (HMCS) has confirmed the arrival of 10 Third Country Nationals from the United States of America (USA), who have been securely accommodated at one of Eswatini’s correctional facilities.

According to a statement issued by HMCS Deputy Public Relations Officer (PRO) Assistant Chief Officer Baphelele Kunene, the individuals arrived in the country on Monday, 6 October 2025, and are currently undergoing standard admission processes.

The department stated that the nationals are in good health and that their arrival forms part of an ongoing collaborative effort between the Government of Eswatini and relevant local and international stakeholders to facilitate their orderly repatriation.

“These nationals have been securely accommodated in one of the country’s Correctional Facilities, as Government continues to collaborate with relevant local and international stakeholders to facilitate their orderly repatriation,” said Kunene in the statement.

Who Are ‘Third Country Nationals’?

In international correctional and migration terms, Third Country Nationals refers to individuals who are citizens of a country different from both the host country (Eswatini) and the country of origin involved in repatriation or transfer agreements.
Such individuals may be relocated for reasons ranging from international cooperation on law enforcement, migration management, humanitarian repatriation, or detention under international protocols.

Kunene did not disclose the nature of the circumstances surrounding the arrival of the 10 nationals, citing the Correctional Services Act, which safeguards the privacy and confidentiality of inmates’ information, allowing access only to legally authorised parties.

Security and Safety Measures

The HMCS spokesperson emphasised that strict security protocols are being followed to ensure the safety of both the general public and all inmates.

“We reiterate Government’s assurance that the individuals pose no immediate threat to public safety, as they remain under strict supervision and care within the Department’s facilities,” Kunene said.

The department assured the public that it continues to work closely with law enforcement, foreign affairs, and humanitarian agencies to ensure transparency and compliance with national and international standards.

Commitment to Human Rights and Legal Standards

HMCS reaffirmed its commitment to the humane treatment of all persons in its custody, in line with Eswatini’s Correctional Services Act and international conventions such as the United Nations Standard Minimum Rules for the Treatment of Prisoners (the Nelson Mandela Rules).

“The Department continues to uphold principles of dignity, fairness, and respect for human rights, in accordance with national legislation and international correctional standards,” he said.

The HMCS Public Relations Office further stated that Eswatini remains a responsible international partner, working collaboratively with other nations to uphold human rights, order, and justice.

The statement concluded by confirming the Department’s continued cooperation with relevant authorities to ensure a smooth and secure repatriation process for the nationals.
